Legal Disclaimer
Important limitations of liability and service disclosures regarding your use of the Paybachat platform.
The information, services, APIs, and products provided on the Paybachat platform are owned and operated by Shilvora Software Private Limited. By using our platform, you expressly agree to the following disclaimers and limitations of liability.
1. "As-Is" Service Availability
Paybachat provides its services (including but not limited to BBPS, AEPS, DMT, and Recharge) on an "as is" and "as available" basis. While we strive for 99.9% uptime, we make no representations or warranties of any kind, express or implied, regarding the continuous, uninterrupted, or error-free operation of our platform.
2. Third-Party Network Dependencies
Our platform operates as an aggregator and technology facilitator. The actual routing of funds and execution of transactions rely entirely on external third-party entities, including:
- National Payments Corporation of India (NPCI)
- Sponsor Banks and RBI-regulated financial institutions
- Telecom Operators (Jio, Airtel, VI, BSNL) and DTH Providers
- Utility Biller Networks (Electricity boards, Gas providers, etc.)
Disclaimer: Shilvora Software Private Limited assumes no liability for delayed settlements, failed transactions, or financial losses resulting directly from server downtimes, maintenance windows, or technical failures on the part of these third-party networks.
3. Accuracy of Transaction Data
Merchants and API partners are solely responsible for verifying the accuracy of all transaction details (e.g., Mobile Numbers, Bank Account Numbers, IFSC codes, Biller IDs) before initiating a payment. Paybachat will not be held responsible for funds transferred to incorrect accounts due to user error, nor can we facilitate the retrieval of such funds once successfully processed by the banking network.
4. No Financial or Investment Advice
Nothing on the Paybachat website, application, or marketing materials should be construed as financial, investment, legal, or tax advice. We provide digital payment infrastructure, not banking or advisory services. Merchants are responsible for managing their own taxes (GST, TDS) and financial liabilities arising from their business operations.
5. Fraud and Unauthorized Access
While we implement strict 256-bit encryption and security protocols, the merchant/user is responsible for safeguarding their login credentials, API keys, and OTPs. Paybachat is not liable for any financial damages arising from unauthorized access to your account resulting from phishing, social engineering, device theft, or negligence on your part.
6. External Links
Our website or application may contain links to third-party websites. These links are provided for convenience only. Shilvora Software Private Limited has no control over the content, privacy policies, or practices of external sites and accepts no responsibility for any loss or damage that may arise from your use of them.
7. Limitation of Liability
In no event shall Shilvora Software Private Limited, its directors, employees, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or goodwill) arising out of or in connection with your use of the Paybachat platform, even if we have been advised of the possibility of such damages.
