Terms & Conditions

Please read these terms carefully before using the Paybachat platform and services.

Welcome to Paybachat, a registered trademark and fintech service platform operated by Shilvora Software Private Limited. By accessing our website, mobile application, APIs, or utilizing our services (including Recharge, BBPS, AEPS, and DMT), you agree to comply with and be bound by the following Terms and Conditions.

1. Acceptance of Terms

By creating an account, becoming a merchant/distributor, or using any services provided by Paybachat, you acknowledge that you have read, understood, and agree to be bound by these Terms, alongside our Privacy Policy and Merchant Guidelines. If you do not agree, you must abstain from using our platform.

2. Description of Services

Paybachat provides digital financial services and API integrations, which include but are not limited to:

  • Prepaid Mobile and DTH Recharge
  • Utility Bill Payments via the Bharat Bill Payment System (BBPS)
  • Aadhaar Enabled Payment System (AEPS) and Micro ATM
  • Domestic Money Transfer (DMT)
  • FASTag Recharges

We act strictly as a technology facilitator and aggregator. The actual financial transactions are routed through NPCI, RBI-approved banks, and authorized billers.

3. User Account, Password, and Security

3.1 KYC Compliance

All merchants and distributors are required to complete full KYC (Know Your Customer) verification as mandated by the Reserve Bank of India (RBI). Failure to provide accurate information will result in immediate account suspension.

3.2 Account Security

You are solely responsible for maintaining the confidentiality of your Paybachat Merchant ID, password, and transaction PINs. Paybachat will never ask for your password or OTP. We are not liable for any financial loss arising from unauthorized access to your account due to your negligence.

4. Transaction Terms and Liabilities

  • Accuracy of Information: The merchant is responsible for entering correct details (Mobile number, Customer ID, Bank Account Number) during transactions. Paybachat is not liable for transactions made to incorrect accounts.
  • Failed Transactions: In the event of a network timeout where money is deducted but the service is not provided, the amount will automatically be refunded to your Paybachat wallet within 3 to 7 working days, subject to the respective bank/biller's reconciliation process.
  • Chargebacks: Any fraudulent transactions flagged by partner banks or NPCI will result in an immediate debit from the merchant's wallet and potential legal action.

5. Prohibited Activities

While using the Paybachat platform, you strictly agree not to:

  1. Use the platform for any illegal activities, money laundering, or terror financing.
  2. Attempt to hack, reverse engineer, or disrupt our APIs and server infrastructure.
  3. Charge customers more than the prescribed limits/convenience fees for services like AEPS or DMT.
  4. Use the brand name "Paybachat" or "Shilvora Software" maliciously to defraud customers.

6. Intellectual Property Rights

All content, source code, logos, designs, and APIs available on the Paybachat website and application are the exclusive intellectual property of Shilvora Software Private Limited. Unauthorized reproduction or commercial distribution is strictly prohibited and protected under Indian Copyright and Trademark laws.

7. Limitation of Liability

Paybachat relies on third-party networks (Telecom Operators, Banks, NPCI, Billers). Therefore, Shilvora Software Private Limited shall not be held liable for:

  • Service downtimes caused by third-party bank servers or telecom network failures.
  • Loss of profits, business interruptions, or data loss arising from the use or inability to use our services.

8. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal.

9. Amendments to Terms

Shilvora Software Private Limited reserves the right to modify, add, or remove portions of these Terms and Conditions at any time. Merchants will be notified of significant changes, and continued use of the platform constitutes acceptance of the new terms.
